Open Question: Small Claims suit, funeral costs, Advice?
My father passed away back in November 22, 2008 from a heart attack. At the time my Mother, Sister an myself were going to pay for it ourselves.

1) We never asked them to pay for the funeral. They offered and stated they would take care of it.
2) We were going to pay for the funeral.
3) Sister offered to pay them $5,000 but they refused to accept it and stated not to worry that they would take care of it.
4) Since they refused the $5,000, we gave Jimmy the listing to sell our house.
5) Jimmy did a bad job of selling the house, so we decided not to use him to buy a house and now he is trying to recollect the money they gave as a gift since they offered.
6) He is currently having personal issues, so he is trying to collect the money they gave as a gift. These issues are mainly circled around his son.
7) There was never an agreement to repay……no time-frame to repay was set, no payment schedule, no amount to be repaid, no nothing.

I guess based on the recap of events that have occurred, what is your take on the situation should there be a lawsuit? Where would we stand? Is it possible for them to expect repayment for something there never was an agreement for (written or oral)?

As of recently they have also requested a few different amounts to be repaid. Originally our selling Realtor, Jimmy, had asked my mother at the close of escrow if she could give him $5,000 since they had paid for our father’s funeral due to them having their own personal issues (mentioned above about their son). Then my sister had a brief conversation with Jimmy via telephone because he caught her on her work telephone and he stated him and his wife agreed to pay for half so we owe them $5,000. There after his wife, Olivia, showed up at my mom’s work and asked about repayment of the total funeral expenses. Now we received the letter below which is stating we agreed and promised to pay $4,174.00 by July 31, 2009, or they will take legal steps to collect the full amount of $9,174.00. I do not understand how they can state in their letter that my mother agreed and promised to pay $4,174.00, when each time they have requested a different amount to be repaid and there were never any agreement.

There are a few other facts about the letter that are inaccurate. The letter is stating they had to make an unannounced visit to our mother’s work since she was not returning Jimmy’s phone calls, but in actuality he only called once because the remaining calls were mainly made to my sister on her cell phone or work. One occasion he even called my sister’s boyfriend on his cell phone. Furthermore, it is stating that my mother did not have the money for the funeral and that she had no one to help her which is also inaccurate. My mother, sister, and myself had already come to a conclusion as to how we were going to pay for the funeral amongst ourselves, but even when we told them we can take care of it they still stated not to worry that they would take care of it. As mentioned in the recap above, I offered to give them $5,000 at the time the expense was incurred and they refused and reiterated they would take care of it. We even had other family members, co-workers, friends, and neighbors who donated money due to the death of our father. My sister alone could have paid for the funeral expense with her savings. As you can see, we had our own means to pay for the funeral.

Now they have served my mother for small claims in the amount of $7500 for the funeral costs, stating the my mother agreed/promised to pay them back after the sale of home.

I just wanted to see what your thoughts are about our situation.

Open Question: OMG I got ripoff financially looking for a job. Did that happened to you?
It started after opening cell-phone bill. I was in shock that it cost $202. Usually costing $125.
It turns out while I was looking for a job on yahoo internet. Click in the hot jobs. Couple of funny icons indicating more places to fill out job applications. It ask for cell-phone number. A big mastake by filling in. It goes into other deals. Remembering I’m looking for a job deciding to pull out. My cell-phone starts ringing one text message after another.
The bill says I have sign on between 6 to 8 new deals. Each cost $10 application fees that I have no intentions to take.
I took that bill to Verizon Wireless store. To find out what happened. A sale rep explain it. Killed off these imposed deals. Advise me not to use internet to find job. Still have to pay that large bill.
I still think I got gypped.
What do you think?

I am an industrialist. I work with small machines and hand tools. Never been head of any group. Nor work any computer for profession.
I drove a small truck delivering pizzas.
I personnally do not believe I be make any money work on any internet.
